Proposed Rulemaking: AoA Proposed Rule – State LTC Ombudsman Program

The Older Americans Act provided an outline of the Ombudsman Program, but no regulations were ever promulgated for any Title VII program. As a result, there is wide variation from state-to-state in the Ombudsman Program.

The purpose of the proposed rule is to provide increased direction and uniformity in implementation of the program, and has a 60-day comment period, closing on Aug. 19, 2013.

One of the more significant clarifications in the 21 page document is related to “Functions and Duties of the Office of the State Long-Term Care Ombudsman”, specifically those related to “identify, investigate, and resolve complaints made by or on behalf of residents''.
