Proposed Regulations on Discharge and Transfer

The amendments to 10NYCRR 415.3 are intended to provide clearer guidance with respect to the discharge and transfer process for nursing home residents.  The interim regulations addressing discharge and transfer rights had been in place since July 2005.  The amendments provide timelines, address notification and appeal rights, and more closely align state regulations with current federal requirements.  The comment period on the proposed regulations ends Nov. 24.  LeadingAge NY will submit comments on behalf of our members. Please send any comments or concerns prior to Nov. 17.
