Life Safety Code Waivers
Under current regulations, CMS may waive specific provisions of the LSC in cases where if rigidly applied would result in unreasonable hardship on the provider. In order for the waiver to be considered, there would have to be no adverse impact on resident health and safety. Among the areas highlighted in S&C letter 13-58 are provisions related to emergency generators, and based on the clinical condition of the resident, allowance of a door locking arrangement for the safety of resident(s). The CMS letter outlines the waiver process and provides additional areas where categorical waivers would be considered.
