Guidance on Exec. Comp. and Administrative Limits

The Executive Order #38 website is intended to provide information to entities receiving state funds and state-authorized payments, as well as a mechanism for submitting applications for waivers to the executive compensation and administrative cost limits. Included are a frequently asked questions section and a 149-page preliminary guidance document. By way of review, the final regulations became effective July 1, 2013 and will begin to apply to providers upon the start of their next fiscal year or cost reporting period. For most covered LeadingAge New York members, the limits will begin to apply as of Jan. 1, 2014. Hinman Straub, our general and legislative counsel, is currently preparing an analysis of the guidance documents which we will share with the membership in the near future.

Reportedly, two lawsuits have been filed in state Supreme Court by affected home care and early intervention providers, respectively. LeadingAge New York’s Legal Services Committee is closely monitoring the status of this litigation as well as implementation of the regulations.
