HUD Issues Proposed Regulations for Section 202, Section 811, Service Coordinators and ALCP

On Oct. 7 Housing and Urban Development (HUD) issued a Federal Register notice seeking public comment on changes to the Supportive Housing and Services for the Elderly (Section 202) and Persons With Disabilities (Section 811) programs. The notice is attached and can also be found here.

In addition to proposing regulations to implement reforms of these two statutes, this proposed rule would implement several other changes including:

  • Establish the requirements and procedures for the use of new project rental assistance for supportive housing for persons with disabilities;
  • The implementation of an enhanced project rental assistance contract;
  • Allowance of a set-aside for a number of units for elderly individuals with functional limitations or other category of elderly persons as defined in the Notice of Funding Availability (NOFA); 
  • Make significant changes for the prepayment of certain loans for supportive housing for the elderly;
  • Implement a new form of rental assistance called Senior Preservation Rental Assistance Contracts (SPRACs);
  • Modernize the capital advance for supportive housing for persons with disabilities; and 
  • Provide grant assistance for applicants without sufficient capital to prepare a site for a funding competition.

This rule also proposes to establish the regulations for the Service Coordinators in Multifamily Housing program and the Assisted Living Conversion Program (ALCP). Neither the Service Coordinator nor the ALCP has ever been overseen by HUD through regulation.  Program guidance has been provided over time for these programs through other policy documents such as Notices of Funding Availability, handbooks, program notices, and memoranda. The proposed rule has a lengthy prefatory section, explaining the purpose and intent of the proposed policies.  The actual proposed rule for the Service Coordinators in Multifamily Housing and Assisted Living Conversion Program begins on page 60627. 

Comments for the Section 202, Section 811, service coordinator and ALCP are due on Dec. 8, 2014.

LeadingAge NY will work with our Housing Cabinet and other members to review the proposed rules for the Section 202, Assisted Living Conversion Program (ALCP) and service coordinator programs and make suggestions to HUD for the final regulations.
