Updated HCBS Settings Rule Transition Plan Available

The Department of Health (DOH) posted the revised HCBS Statewide Transition plan for public comment. LeadingAge NY has been monitoring this issue closely, as it is likely to have broad impact on those receiving home and community based services under a Medicaid waiver, including managed long term care. You may recall that DOH issued an initial transition plan last year. According to DOH, only five comments were received on the initial plan, and LeadingAge NY was one of them. Our comments can be viewed here

The transition plan outlines how the State intends to come into compliance with the federal rule over the next five years. The State is accepting comments on the plan until Tues., March 3, 2015 via e-mail to OLTCDHCBS@nyhealth.gov. DOH will submit a final plan to the Centers for Medicare and Medicaid Services (CMS) by Tues., March 17, 2015.

LeadingAge NY is compiling remarks on this revised draft transition plan, so please let us know if you have any comments you would like to see included. In addition, you may submit comments directly to the e-mail address above..
