The proposed federal regulations establishing minimum staffing requirements for nursing homes moved to the final stage in the review process last week, while a bill to block the adoption of the regulations moved through the House Ways and Means Committee.

Based on recent release of federal staffing data, 7 in 10 homes were still not able to meet staffing requirements in Q3 of 2023.

Redetermination and penalty reduction requests must be submitted within 10 business days of notice date.

The notices were distributed via the HCDMS, along with an email alert, on Jan. 12^th. Facilities will have 10 days to request a redetermination or mitigation.

Without a concerted public and private effort to build the workforce, and absent adequate rates from government payers to cover the costs of current and additional staffing levels, the proposed regulations will not promote improvements in care and will lead to reduced access.

Quarterly submission determines Five-Star staffing ratings and is used to test compliance with State staffing requirements.
