DOH Issues CNA Recertification Reminder DAL

(Oct. 31, 2025) The Department of Health (DOH) has issued Dear Administrator Letter (DAL) Division of Residential Support (DRS) 25-07, dated Oct. 28, 2025, to reaffirm the regulatory requirements and policies surrounding the recertification of Certified Nurse Aides (CNAs) in nursing homes. This guidance serves as a reminder that no changes have been made to the existing recertification process, but facilities are encouraged to review their internal procedures to ensure ongoing compliance.

Under Title 10 of NY Codes, Rules, and Regulations (NYCRR) § 415.26(d)(6), CNAs must be recertified every two years, with the renewal due no later than the last day of the month in which their original certification was issued. To qualify, CNAs must have completed at least seven hours of compensated work as a nurse aide within the previous 24 months. Importantly, only health care facilities licensed under Article 28 of the Public Health Law are authorized to recertify CNAs. Entities such as Adult Care Facilities (ACFs) (Article 7) and home care services agencies (Article 36) are not eligible, as they do not meet the definition of a health care facility under the applicable regulations.
