Minor Change in Regulation a Small Win for Providers

The Public Health and Health Planning Council (PHHPC) recently met and reviewed various emergency regulations that pertain to our members. According to the Department of Health (DOH), three of the four regulations had no material changes.

The Department, based on feedback from LeadingAge NY and the provider community, removed the weekly certification requirement for nursing homes and adult care facilities (ACFs) regarding the COVID-19 vaccinations of nursing home and ACF residents and personnel. Click here to view the revised regulations, which were published on Oct. 28, 2021. While a small victory, we are pleased that the Department responded to our advocacy. We will continue to work to peel away requirements that do not add value to residents or quality of care.

DOH also republished on Oct. 28th the Surge and Flex Health Coordination System and Hospital and Nursing Home Personal Protective Equipment (PPE) Requirements regulations, again reportedly without change.

The Department indicated that the COVID-19 Confirmatory Testing Regulations would also be republished without material changes, but this has not yet occurred.
