The Check Is in the Mail

Nursing home members whose designated Universal Settlement Trustee is the law firm Hinman Straub should be receiving their main Settlement checks this week. The bulk of the payments were sent by UPS on Mon., Dec. 16th. Please note that as in prior years, most payments that are attributable to specific lawsuits are forwarded to the law firm(s) of record for the litigation, which then makes the payment to your facility.

This represents the fifth and final distribution of the Universal Settlement, which provided five annual payments to nursing homes to settle the majority of pending litigation and outstanding appeals impacting Medicaid rates prior to Jan. 1, 2012. Under the Settlement terms, the State is authorized to net any Medicaid liabilities owed by a provider against their Settlement payment. Updates to cash receipts assessment reimbursement amounts implemented by the Department of Health (DOH) in November 2019 generated liability offsets for a number of facilities.
