SADCs and HCBS Settings Rule

LeadingAge NY recently learned that Social Adult Day Care (SADC) programs will be receiving information from their contracting Managed Long Term Care (MLTC) plans in the next few weeks, as the Department of Health (DOH) has asked plans to facilitate assessments of SADC program compliance/status with requirements of the Home and Community-Based Services (HCBS) Settings Rule. Members may recall that this requirement calls for community integration to the greatest extent possible of individuals receiving HCBS Medicaid services and may require a heightened scrutiny review for SADC programs located on the premises of a sponsoring nursing home or congregate facility.

The new deadline for compliance with the rule has been extended to March 17, 2023, as indicated here. For background on the HCBS Settings Rule, visit the DOH website here. LeadingAge NY will be reaching out to members to provide more information.
