EVV Compliance Required for Providers of Home Health Services in January 2023
As members are aware, Electronic Visit Verification (EVV) is currently required for Medicaid personal care services (PCS), and in January 2023, the requirement will be effective for home health services. The requirement was established in 2016 by the federal 21st Century Cures Act, and states are required to have all home care providers set up visit verification systems to track Medicaid personal care and home health services in the home.
Members should note that EVV applies to the full array of personal care and home health services, including home health nursing and therapy services. Applicable EVV billing codes are here.
Members should note that EVV is only required for care provided in the home, not in congregate settings. More on EVV is available here.
All providers of Medicaid-funded home health services that begin or end in the home and include activities of daily living (ADLs) or instrumental activities of daily living (IADLs) must implement EVV.
To ensure compliance, providers should complete the following steps:
- Review the EVV Applicable Billing Codes document to see if the services you provide are applicable to EVV requirements
- Review the Technical User Guide to learn more about how to submit EVV data to the State
- Select and implement an EVV solution
- Test your solution with New York’s aggregator
- Complete and electronically sign the EVV Attestation on the eMedNY EVV page
- Review EVV training requirements
- Collect EVV data related to all Medicaid-funded home health care services
- Submit production data to the aggregator
