LeadingAge New York opposes this legislation which would require every nursing home facility in the state to prominently post the most recent star ratings for health inspections, staffing, and quality measures pursuant to the inspection rating system of the federal Center for Medicare and Medicaid Services (CMS).

LeadingAge New York opposes this bill which would raise the maximum penalties for violations of the Public Health Law.   These enhanced penalties would apply to any individual or organization that violates the Public Health Law.

Requires an annual audit of facilities that receive funds under the EQUAL program, increases maximum civil penalties for ACF violations from $1,000 per day to $5,000 per violation per day, and authorizes a pre-hearing suspension or limitation of an ACF’s operating certificate in cases of imminent danger to residents.

This bill would establish a demonstration program allowing one or more Managed Long Term Care (MLTC) plans that operate in rural counties and that have demonstrated success in transitioning individuals in need of a nursing home level of care from the nursing home to the community to enroll and manage the care of permanently placed nursing home residents for periods longer than three months. LeadingAge NY supports this legislation.
