Update on the Fair Labor Standards Act (FLSA) Disbursement Methodology

This is a follow-up to LeadingAge New York along with other home care associations meeting with Department of Health (DOH) staff on May 9th to discuss Fair Labor Standards Act (FLSA) funding questions and concerns. We had requested from DOH a list similar to the Quality Incentive Vital Access Provider Pool (QIVAPP) program on the funds the plans received and, if possible, how the funds were disbursed to the providers. DOH has now posted a breakdown of the managed care plans disbursement methodology to home care providers. Please review the chart and let us know if you see any discrepancies.

LeadingAge NY has reviewed the chart and found the following methodologies:

-  one plan paid $0.34 per hour for the time period of Oct. 2015 – Mar. 2016;

-  distributed a survey to providers to compare hours from Oct. 2015 – Feb. 2016 to paid claims and then calculated overtime and travel;

-  overtime and travel hours percentages were based on a survey;

-  based upon a percentage of hours in the fourth quarter of 2015;

-  lump sum payments on proportionate of hours during the third quarter of 2015; or

-  based upon the hours between Oct. 2015 – Mar. 9, 2016.

It is important to note the vast majority of managed care plans have distributed the funds.

DOH still maintains they can’t provide the actual dollar amount the plans disbursed to home care providers. DOH stated it will be the responsibility of the NYS Office of the Medicaid Inspector General to ensure all of the FLSA funds were properly disbursed.
