Elder Justice Act: Reporting Reasonable Suspicion of Crime in LTC Facilities
Format: Audio conference (available online)
Date: Recorded July 28, 2011 (Length of session: 75 minutes)
Program Summary: With the passage of the Patient Protection and Affordable Care Act (“PPACA”) on March 23, 2010, the federal government sought to strengthen protections for persons residing in long term care facilities. Specifically, PPACA’s Elder Justice Act, among other things, established certain reporting requirements on long term care facilities and their employees when there is a reasonable suspicion of crime committed against a resident. Although the Department of Health and Human Services has yet to promulgate any regulations implementing the reporting requirements, the Centers for Medicare and Medicaid Services (“CMS”) has recently provided guidance for nursing facilities and “covered employees” as well as State survey agencies (Department of Health) on how to comply with the Elder Justice Act’s provisions. This guidance should be implemented as soon as possible to avoid the risk of potentially substantial penalties.
